The world of process serving is often full of interpretation – it should be done like that – it should be done like this….<\/p>\n\n\n\n

Fortunately, we have an up to date elearn process server<\/a> repository and I keep it bang on the money…<\/p>\n\n\n\n

One of my students used one of the templates on the elearn platform and received the following from a fellow member of his trade body…<\/p>\n\n\n\n

Thank you for this.\u00a0 The certificate \u00a0\u201cstatement of truth\u201d was updated a year ago to\u00a0<\/p>\n\n\n\n

\u201cI understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.\u201d\u00a0\u00a0 Would you please amend the certificate to read the new statement of truth.<\/p>\n\n\n\n

I began to look at matters and noticed that the EX550<\/a> on the Gov.Uk website had not updated with the, “New declaration”, indeed none of the usual, downloadable proformas had updated at all…<\/p>\n\n\n\n

I traced back to the first time I heard about the “Update”…<\/p>\n\n\n\n

An email circulated around a trade group on the 16th April 2020, it reads:<\/p>\n\n\n\n

I received the following communication from a solicitor client today, as follows:<\/p>\n\n\n\n

The 113th Practice Direction (PD) Update was published on 6 February 2020.  The changes to PD 22 include that the statement of truth in witness statements must include a warning that contempt  proceedings may be brought for giving a statement of truth without an honest belief in its truth.  With effect from 6 April 2020, the following wording should be included in Witness Statements:<\/p>\n\n\n\n

“I believe the facts stated in this witness statement are true. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.”<\/em><\/p>\n\n\n\n
